Territorial dispute is a disagreement over the possessions or control of land between two or more territorial entities or over the possession or control of land, usually between a new state and the occupying power. Territorial disputes are often related to the possession such as water, fertile land, minerals, oil or other valuable resources. Territorial disputes result often from vague and unclear language in a treaty that set up the original boundary are Territorial disputes are a major cause of conflicts between two parties over a territory through invasion, and non-state entities try to influence the actions of politicians through terrorism.
International law does not support the use of force by one state to annex the territory of another state. The United Nations charter articulate that all members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations. In some cases, where the boundary is not demarcated involved parties define a line of control that serves as the “de facto” international border. in the event any decision will be concluded for a disputed borders, then that decision shall be based on evidences, so that the conflicting parties have the same opinion about the issue under dispute. No one has the right to issue a conclusion without the availability of evidences. But what is evidence. Evidence, broadly construed, is anything presented in support of an assertion.
This support may be strong or weak. The strongest type of evidence is that which provides direct proof of the truth of an assertion. At the other extreme is evidence that is merely consistent with an assertion but does not rule out other, contradictory assertions, as in circumstances evidences in law, rules of evidences govern the types of evidence that are admissible in a legal proceeding. Types of legal evidence include testimony, documentary and physical evidences. . Evidence and rules are used to decide question of fact that are disputed, some of which may be determined by the legal burden proof relevant to the case. Territorial disputes have significant meaning for the society because it is related to the fundamental rights. The inferences by traditional chiefs to our border disputes are unethical and can influences dividing society into camps having different interest and therefore, we should eliminate this awful culture. The role of traditional chiefs for our society is look after the blood money of their clans and sub-clans.
In conclusion, the government should call both parties and listen the arguments of both sides prior taking hasty decision. Upon reviewing the evidences provided by both sides, the government can understand the party at blunder and the party having acceptable evidences. by then the government can take final judgement upon evaluating the evidences provided by the conflicting parties. This is the international standards in the event conflicts arise from two parties and other approach will only prolong the issue indefinitely. The first thing to understand about the final judgment is that it cannot be avoided. appraising the manner in which our interior is behaving with regard the issue of border dispute, the ministry lost the the trust of the public confidences. Last, but not least, it was wrong judgment to issue a a decree to nominate a district or region without marking the border lines for the adjustment regions and districts and such practice shall be avoided in future in order to distances future conflicts like the one between Salahley and Hargeisa that already consequence human causality.
